Terms and Conditions

1. General Scope

YOESH acts solely as a ticketing service provider and not as the organizer of the events listed. The event organizer is solely responsible for executing the event and issuing the tickets. When you purchase a ticket, the contractual relationship concerning event attendance is exclusively between you (the ticket holder) and the event organizer. The organizer may have their own Terms & Conditions, which apply separately. YOESH sells tickets on behalf of organizers as an intermediary or commission agent unless otherwise stated. By placing an order, the customer commissions YOESH to process the ticket purchase, including delivery.

2. Account Registration and Use

Customers may create a free YOESH account by registering on the platform. This account allows users to:

  • Subscribe to newsletters

  • Set alerts for favorite artists

  • Enroll in loyalty programs (e.g., FanBonus)

  • Manage personal information

  • View past orders

The account is activated upon receipt of a confirmation email. Users must keep login credentials secure and notify YOESH of any unauthorized access immediately.
Accounts may be terminated by the user without notice at any time. YOESH may retain the account until all obligations are fulfilled. An active account is required to use YOESH.Pass (see Section 7). YOESH reserves the right to temporarily suspend or permanently terminate accounts in case of misuse or security violations.

3. Applicability of Terms

These Terms apply to all contracts and orders relating to the sale of tickets, vouchers, and merchandise via YOESH. For travel services, YOESH’s travel terms and/or the travel organizer’s terms apply, as indicated in the specific offer.

4. Contract Formation & Cancellations

By clicking the “Buy” button, the customer makes a binding offer to purchase. The contract becomes effective once YOESH confirms the transaction with an order number. For advance payments, the contract is valid upon receipt of full payment.

Tickets may not be resold commercially. Private resales are permitted only at face value plus documented original fees, with a cap of 25% over the printed price. Violations may lead to cancellation or denial of entry by the organizer.

YOESH may cancel an order if the customer:

  • Violates ticket quantity limits or resale rules

  • Uses multiple accounts to bypass restrictions

  • Has unpaid balances

If an event is rescheduled, the ticket remains valid for the new date unless attendance is proven to be unreasonable for the customer.

In case of conflicting clauses, YOESH’s Terms take precedence over the organizer’s.

5. Pricing & Payment Terms

Ticket prices may exceed printed face value due to facilities fees. Payment methods include:

  • SEPA Direct Debit

  • Credit Card

  • PayPal

  • Advance Bank Transfer

  • Klarna (Invoice or Installments, subject to credit approval)

The full amount is due immediately upon order unless using Klarna, in which case their terms apply. Additional costs (e.g., shipping or booking fees) vary by event and are shown during checkout.

YOESH may conduct credit checks when SEPA is selected. Information may be shared with credit bureaus (e.g., SCHUFA, Boniversum, infoscore) under GDPR compliance.

6. Right of Withdrawal (Cancellations & Refunds)

There is no right of withdrawal for:

  • Event tickets

  • Services related to leisure activities at fixed times

  • Unsealed media (CDs, software, etc.)

For other products, customers have 14 days to cancel their purchase. Refunds are issued using the original payment method, and return shipping is the customer's responsibility. Goods must be returned in unused condition to avoid deduction.

7. Ownership, Offsetting & Withholding Rights

Ownership of goods remains with YOESH until full payment is received. For personalized tickets, transfer of usage rights is conditional on payment.
Customers may only offset claims if they are legally confirmed or recognized by YOESH. Withholding rights apply only if claims stem from the same contract.
If the customer is in default, all outstanding payments become due immediately.

8. YOESH.Pass (Digital Entry Access)

YOESH.Pass is a digital entry ticket accessed via the YOESH app. No paper ticket will be issued. The pass must be shown at the event entrance using a mobile device.
YOESH may require identity verification (e.g., via TAN code) to ensure proper usage. Access may be suspended until verification is complete. Compatible devices and possibly a mobile number are required.

9. Liability Limitations

YOESH is fully liable in cases of:

  • Product liability

  • Intentional or gross negligence

  • Injury or loss of life

  • Fraud or warranty breaches

In cases of minor negligence:

  • YOESH is liable only for breach of essential contractual duties (cardinal obligations)

  • YOESH is not liable for indirect damages or minor breaches

These limitations also apply to YOESH’s subcontractors and agents.

10. Governing Law & Legal Venue

These Terms are governed by the laws of the Federal Republic of Germany. Consumers outside Germany may also invoke their local consumer protection laws.
For businesses, the exclusive jurisdiction is Hamburg, Germany. YOESH may alternatively pursue legal action in other competent jurisdictions.
YOESH is not obligated to participate in consumer arbitration.
